What would change
The existing offense for purchasing or selling a human organ is increased from a Class A misdemeanor to a state jail felony. The Texas Medical Board must revoke the license of a physician who knowingly uses an organ obtained in violation of the Penal Code prohibition.

Organ donors and transplant recipients, physicians and transplant programs, law-enforcement agencies, prosecutors, courts, and the Texas Medical Board.
When it would take effect
The Act took effect September 1, 2025. The higher criminal penalty applies only to offenses committed on or after that date, and the physician-license provision applies prospectively as specified by the Act.
Limits and uncertainty
The statute continues to operate within the existing definition and exceptions of Texas' human-organ sale law; legitimate organ donation and lawful transplant activity are not converted into criminal conduct.
