SB 1963 expands Texas electric-utility disaster-cost securitization so utilities can use lower-cost bond financing to recover large system-restoration costs after weather events or other natural disasters.
What would change
The Act removes the prior limitation that the financing mechanism apply only to utilities operating solely outside ERCOT and allows an electric utility to seek securitization for at least $50 million of estimated and actual system-restoration costs in a calendar year. The Public Utility Commission must decide qualifying applications and financing orders within 150 days, with later true-up and reconciliation when actual costs are known.
Who may be affected
Electric utilities, utility customers who may pay system-restoration charges, the Public Utility Commission of Texas, bond investors and issuers, and communities affected by major storm or disaster restoration costs.
When it would take effect
The Act takes effect September 1, 2025. It did not receive the House vote required for immediate effect.
Limits and uncertainty
Securitization is not automatic. A utility must satisfy the statutory thresholds and obtain PUC determinations and financing orders, and estimated costs remain subject to true-up after actual restoration costs are established.
